Terms of Service

1. Acceptance of terms

By creating a HomePlate account or using homeplate.care, you agree to these Terms of Service. If you do not agree, do not use the service. These terms apply to all users: families (consumers), facility partners, and delivery drivers.

2. The service

HomePlate is a marketplace that connects families with senior care facilities to arrange weekly home-delivered meal service. HomePlate does not prepare food. All meals are prepared by licensed, inspected senior care facilities ("Facility Partners") that have agreed to HomePlate's partner terms.

HomePlate facilitates payment, logistics coordination, and quality monitoring but is not a food manufacturer, distributor, or healthcare provider.

3. Eligibility

You must be at least 18 years old to create an account. By signing up, you represent that all information you provide is accurate and that you have authority to enter these terms on behalf of yourself and any individual whose meals you are arranging.

4. Meal service and subscriptions

  • Meal plans are priced at $150.00 per week (weekly subscription) or $150.00 per delivery (one-time).
  • Weekly subscriptions renew automatically each week. You may cancel at any time from your dashboard before the next billing date.
  • A $10.00 delivery fee applies per delivery and goes directly to your assigned driver.
  • Virginia sales tax (~6%) is applied at checkout as required by law. HomePlate collects and remits VA sales tax as the marketplace facilitator.
  • Payments are processed by Stripe. By subscribing, you authorize HomePlate to charge your payment method on the applicable schedule.

5. Refunds and cancellations

  • Subscriptions may be cancelled before the next billing cycle with no additional charge.
  • No refunds are issued for delivered meals unless there is a demonstrable food safety issue.
  • For failed deliveries or significant quality issues, contact orders@homeplate.care within 24 hours of the scheduled delivery.
  • HomePlate reserves the right to issue credits at its discretion.

6. Dietary and allergy information

Important: You are responsible for providing accurate and complete dietary restrictions and allergen information. HomePlate will share this with your assigned facility, but HomePlate cannot guarantee allergen-free preparation environments.

If you or your family member has life-threatening allergies or complex medical dietary requirements, consult a healthcare provider before using this service. HomePlate is not a medical service.

7. Facility partners

Facility Partners are independent businesses subject to separate partnership agreements. HomePlate does not employ Facility Partners or their kitchen staff. HomePlate verifies facilities hold current health inspection ratings before going live but does not guarantee continuous compliance. Report facility concerns to team@homeplate.care.

8. Delivery drivers

Drivers are independent contractors. HomePlate coordinates but does not directly employ drivers. Delivery windows are estimated and may vary due to traffic, weather, or operational factors. HomePlate is not liable for late deliveries caused by third-party circumstances beyond our control.

9. Prohibited uses

  • Creating false or misleading accounts
  • Using the service to resell meals to third parties
  • Attempting to circumvent payment or promotion systems
  • Harassing, threatening, or abusing HomePlate staff, facility staff, or drivers
  • Interfering with the security or operation of the platform

10. Intellectual property

All content, trademarks, and software comprising HomePlate are owned by HomePlate Health, Inc You may not copy, reproduce, or distribute any part of the service without written permission.

11. Limitation of liability

To the maximum extent permitted by law, HomePlate shall not be liable for indirect, incidental, or consequential damages. HomePlate's total liability for any claim shall not exceed the amount you paid to HomePlate in the 30 days preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless HomePlate Health, Inc and its officers, directors, and employees from any claims, damages, or expenses arising out of your use of the service, violation of these terms, or provision of inaccurate dietary/allergy information.

13. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Disputes shall be resolved in courts located in Fairfax County, Virginia.

14. Changes

We may modify these terms at any time. Material changes will be communicated by email at least 14 days in advance. Continued use of the service after the effective date constitutes acceptance.
